Our terms of sale and cancellation and refund policy

You have a statutory right to cancel your order and receive a full refund within of placing the order. However, if you purchase a product where we need to start the work necessary to fulfil your order within this 14 day period, you have waived your right to a full refund.

These Terms of Sale and any documents referred to herein, set out the sales terms and conditions on which you are permitted to use our website,

. The Terms of Sale also show you what our cancellation and refund policies are for the goods and services we sell.

Please read these Terms of Sale carefully. We recommend that you print off a copy of these Terms of Sale for your records, as well as any future versions of them, as we may update them from time to time.

If for any reason whatsoever you do not agree to these Terms of Sale or do not wish to be bound by them, you must not use our services.

1. Our Details

1.1 MTS (Mobile Testing Solutions Ltd) (we, our and us) operates the website.

1.2 MTS is a limited liability company incorporated in England and Wales (company number 8706098).

2. Definitions

2.1 "Buyer" means the individual or organisation who buys or agrees to buy the Services from the Supplier, (you, your)

2.2 "Consumer" shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977;

2.3 "Contract" means the contract between the Supplier and the Buyer for the provision of Services incorporating these Terms and Conditions;

2.4 "Services" means the services that the Buyer agrees to buy from the Supplier;

2.5 "Supplier" means MTS (we, our and us)

2.6 "Terms and Conditions" means the terms and conditions for the provision of Services set out in this agreement and any special terms and conditions agreed in writing by the Supplier

2.7 "Website" means any website owned by MTS, including www.mtsglobal.uk.com.

3. Conditions

3.1 Nothing in these Terms and Conditions shall affect the Buyer's statutory rights as a Consumer.

3.2 These Terms and Conditions shall apply to all contracts for the provision of Services by the Supplier to the Buyer and shall prevail over any other documentation or communication from the Buyer.

3.3 Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Supplier.

3.4 Any complaints should be addressed to the Supplier's address stated in clause 1.

4. Ordering

4.1 All orders for Services shall be deemed to be an offer by the Buyer to purchase Services pursuant to these Terms and Conditions and are subject to acceptance by the Supplier. The Supplier may choose not to accept an order for any reason.

4.2 When making an order through the websites, the technical steps the Buyer needs to take to complete the order process are described in the order processing section of the websites.

5. Price and payment

5.1 The price of the Services shall be that stipulated on the websites or email or other written document.

5.2 The total purchase price will be displayed in the Buyer's shopping cart (or proposal) prior to confirming the order.

5.3 After the order is received the Supplier shall confirm by email the details, description and price for the Services together with information on the right to cancel if the Buyer is a Consumer.

5.4 Payment of the price must be made online at the time of order, unless otherwise agreed. Payment must be made without deduction or set-off.

5.5 Where applicable, if any payment is not paid on time or any payment is rejected or refused, the amount owing will be treated as overdue and the Supplier will be entitled immediately to cease or suspend the provision of the relevant Service until payment has been received.

5.6 Where applicable, the Supplier shall be entitled to charge interest on overdue invoices from the date when payment becomes due from day to day until the date of payment at a rate of 8% per annum above the base rate of the Bank of England from time to time in force.

6. Rights of Supplier

6.1 The Supplier reserves the right to periodically update prices on the websites, which cannot be guaranteed for any period of time. The Supplier shall make every effort to ensure prices are correct at the point at which the Buyer places an order.

6.2 The Supplier reserves the right to withdraw the Services from the websites at any time.

6.3 The Supplier shall not be liable to anyone for withdrawing the Services from the website or for refusing to process an order.

7.1 Where the Services may only be purchased by persons of a certain age the Buyer will be asked when placing an order to declare that they are of the appropriate legal age to purchase the Services.

7.2 If the Supplier discovers that the Buyer is not legally entitled to order certain Services, the Supplier shall be entitled to cancel the order immediately, without notice.

8. Cancellations, transfers and refunds

8.1 In general, you have a statutory right to cancel your order and receive a full refund within 14 days of placing an online order with MTS. However, if you purchase a product where we need to start the work necessary to fulfil your order within this 14 day period, you have waived your right to a full refund.

8.2 Note that MTS is not responsible for daily international exchange rate fluctuations between currencies. Any refunds will be issued according the exchange rate on the day the refund is processed. This may result in you receiving slightly more or less, depending on the exchange rate on the day the return is processed. This policy is typical of international or cross-border shopping and returns. MTS does not benefit from such currency conversion rate changes.

8.3 A refund can only be made to the card you used to pay for the services in the first place. It cannot be paid to another card or into a bank account.

IELTS tests

8.4 If you have purchased an IELTS test from MTS that takes place in more than two weeks' time, you have a 14 day period from the date of payment within which you can change your test date for free, or cancel your test and receive a full refund.

8.5 Once the 14 day period from the date of payment has passed, you can request a transfer or refund but it will be subject to a £45 administration fee.

8.6 If there are 14 days or less until the date of your IELTS test, you can request a transfer or refund but it will be subject to a £45 administration fee.

8.7 No refund or transfer can be offered if you request to cancel or transfer less than 24 hours before your test.

8.9 To request a different test date to the one you originally booked, fill out this form: https://www.mtsglobal.uk.com/ielts/transfer-request

8.10 Under certain circumstances, we may have to change the time of your test. If we change the time of your test, you can cancel your test and receive a refund, or transfer your test to a different day. However, the refund or transfer will be subject to a £45 administration fee.

8.11 Under certain circumstances, we may have to move your test to a different day. If we move your test to a different day, you can cancel your test and receive a full refund, or transfer your test to a different day at no additional cost.

8.12 If you are unable to attend your test or are disadvantaged on test day owing to exceptional events outside your control, you can apply for special consideration. You can apply for special consideration before the test, and up to two calendar days after the test date. If your application for special consideration is successful, you can cancel your test and receive a refund or transfer your test to a different day. The refund or transfer will be subject to a £45 administration fee.

AAT assessments

8.14 If you have purchased an AAT assessment from MTS that takes place in more than two weeks' time, you have a 14 day period from the date of payment within which you can change your test date for free, or cancel your test and receive a full refund.

8.15 If there are 14 days or less until the date of your AAT assessment, you can request a transfer but it will be subject to a £30 administration fee

8.16 If you request a refund or transfer less than three days (72 hours) before the exam, it will be subject to a £30 administration fee.

8.19 No refund or transfer can be offered if you request to cancel or transfer less than 24 hours before the exam.

8.20 If you are unable to attend your exam or are disadvantaged on exam day owing to exceptional events outside your control, you can apply for a refund or transfer afterwards. You can apply up to two calendar days after the exam date. If your application is successful, you can cancel your assessment and receive a refund, or transfer your assessment to a different day. The refund or transfer will be subject to a £30 administration fee

ACCA on-demand

8.22 If you purchase an ACCA on-demand exam that takes place in more than two weeks' time, you have a 14 day period from the date of payment within which you can cancel your order and receive a full refund.

8.23 Once the 14 day period from the date of payment has passed, you can request a refund but it will be subject to a £30 administration fee.

8.24 No refund (or transfer) can be offered if you request to cancel less than 24 hours before your assessment.

8.25 If you are unable to attend your exam because of exceptional circumstances, you can apply for a refund or transfer afterwards. Only serious illness or injury, hospital admission, death of a close family member, or being the victim of a crime or traffic accident, will be considered. You will need a medical certificate, police report or similar proof. These must be sent to us at acca@mtsglobal.uk.com no later than five working days after the exam date.

8.26 To cancel your order and claim a refund, please send an email to acca@mtsglobal.uk.com.

Online Classes and Courses

8.27 If you have purchased an online course or class from MTS Ltd that starts in more than two weeks time, you have a 14 day period from the date of payment within which you can change your mind and receive a full refund.

8.28 If you have purchased an online course/class that starts in less than two weeks time, you can request a refund but it will be subject to a 20% administration fee.

8.29 No refund can be offered if it has been more than 14 days since you paid for the online course/class, or if you request to cancel less than 24 hours before it starts.

8.30 We offer a full refund if you were unable to take part in the course/class because of a serious incident. Documentary evidence such as a medical or police report must be provided no later than five working days after the course/class start date, and a full refund will be issued. Eligible serious incidents include: serious illness or injury, hospital admission, death of a close family member, being the victim of a crime or traffic accident.

8.31 To cancel your order and claim a refund, please send an email to ielts@mtsglobal.uk.com.

Online self-study products

8.32 If you purchase an online self-study product such as a mock test product, you have a 14 day period from the date of payment within which you can change your mind and receive a full refund provided you have not used the product.

8.33 No refund can be offered if it has been more than 14 days since you paid for the product or if you have used the mock tests and guided materials.

8.34 To cancel your order and claim a refund, please send an email to ielts@mtsglobal.uk.com.

One-to-One Tuition Sessions

8.35 Once you have purchased a one-to-one tuition package, you have 14 days within which you can cancel the package and receive a full refund. No refund can be offered if it has been more than 14 days since you paid for the one-to-one package. Once you have scheduled a one-to-one session with your tutor, no refund can be offered if you cancel the package less than 24 hours before the start of the session.

8.36 You can re-schedule a one-to-one session with your tutor provided that you give them 24 hours notice. If you cancel a session less than 24 hours before it starts, or if you do not turn up for a session, you will not be able to re-schedule the session and no refund can be offered.

8.37 We can re-schedule or refund a one-to-one session if you were unable to take part because of a serious incident. Documentary evidence such as a medical or police report must be provided no later than five working days after the one-to-one session date, and a full refund will be issued. Eligible serious incidents include: serious illness or injury, hospital admission, death of a close family member, being the victim of a crime or traffic accident.

Speaking or Writing Clinics

8.38 Once you have purchased a speaking or writing clinic package, you have 14 days within which you can cancel the package and receive a full refund. No refund can be offered if it has been more than 14 days since you paid for the speaking or writing clinic package. Once you have scheduled a one-to-one session with your tutor, no refund can be offered if you cancel the package less than 24 hours before the start of the session.

8.39 You can re-schedule a speaking or writing clinic session with your tutor provided that you give them 24 hours notice. If you cancel a session less than 24 hours before it starts, or if you do not turn up for a session, you will not be able to re-schedule the session and no refund can be offered.

8.40 We can re-schedule or refund a speaking or writing clinic session if you were unable to take part because of a serious incident. Documentary evidence such as a medical or police report must be provided no later than five working days after the speaking or writing clinic session date, and a full refund will be issued. Eligible serious incidents include: serious illness or injury, hospital admission, death of a close family member, being the victim of a crime or traffic accident.

Printed Materials

8.41 If you have purchased our Official IELTS Practice Materials, you have a 14 day period from the date you receive the goods within which you can change your mind and receive a full refund. The packaging must not be broken and the goods must be in good enough condition to resell. You must cover the postage costs of returning them.

9. Complaints

9.1 If you have a complaint about the way that MTS has conducted your exam, you must submit a complaint on the day of your test. Complaints cannot be accepted after midnight of the day of your exam.

9.2 If your complaint is upheld, you will receive a refund or the opportunity to transfer your test to a different day. In some circumstances, there may be an administration charge.

10. Limitations of liability

10.1 Except as may be implied by law where the Buyer is dealing as a Consumer, in the event of any breach of these Terms and Conditions by the Supplier the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the price of the Services and the Supplier shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever.

10.2 Nothing in these Terms and Conditions shall exclude or limit the liability of the Supplier for death or personal injury resulting from the negligence of the Supplier or that of the Supplier's agents or employees.

11. Waiver

11.1 No waiver by the Supplier (whether express or implied) in enforcing any of its rights under this agreement shall prejudice its rights to do so in the future.

12. Force Majeure

12.1 The Supplier shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire or failure of any communications, telecommunications or computer system, and the Supplier shall be entitled to a reasonable extension of its obligations.

13. Severance

13.1 If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.

14. Changes of Terms of Sale

14.1 The Supplier shall be entitled to alter these Terms of Sale at any time but this right shall not affect the existing Terms of Sale accepted by the Buyer upon making a purchase.

14.2 Any renewal of the Services will be subject to the Supplier's then current Terms of sale.
